GENERAL TERMS

Information on the conditions

This document determines the conditions of business, ie the purchase of products and services outside the sales facility of the ELTA Association, via the website and telephone (hereinafter “Terms and Conditions”). These Terms and Conditions also prescribe the terms and conditions relating to the use of the Website by Customers.

The Law on Consumer Protection, the Law on Electronic Commerce, the Law on Trade, the Law on Obligations, as well as other valid regulations of the Republic of Serbia apply to the conditions of distance selling.

By accepting these Terms and Conditions, the manner of returning, ie replacing and returning the products of the ELTA Association is also accepted.

This website is edited by the Association of English Language Teachers – ELTA, with its headquarters at 28 Nemanjina Street, Belgrade registered with the Business Registers Agency under the registration number: 17510479, PIB: 103055392 (hereinafter: “ELTA Association”), telephone number of the Contact Center: (063) 210 460.

ELTA reserves the right to amend and/or add to these Terms and Conditions at any time. TheCustomer is obliged to check the Terms and Conditions in the relevant chapters/sections before each Order, as changes may occur between visits or are the result of an update.

After registration on the website, Customers / Registered Users declare that they have read and understood these Terms and Conditions, that they are familiar with them and fully agree with them, and that they agree to use the website in accordance with them. The right to use the website is not transferable to other natural or legal persons. The registered user is personally responsible for protecting the confidentiality of passwords, in places where they exist.

Definitions and terms

Visitor – a person who uses the website www.ELTA.org.rs, regardless of whether they bought products or services in this way.

Registered User – a registered Website Visitor regardless of whether they are making a purchase or not.

Customer – the buyer of a product or service, ie. a person who uses information society services and who buys at least one product or service through the ELTA online store. A Customer is also a person who orders products or services by phone via the Contact Center number.

Seller – Association of English Language Teachers – ELTA

Order – ELTA form filled in by the Customer, which includes the online/electronic form following the necessary steps to purchase the product (s), and/or services sold in the ELTA online store, as specified in the Terms and Conditions. The Order also includes filling in an online/electronic form that the Customer fills in and sends to the Seller for the purpose of purchasing products and services. The Order is realized by calling the Seller’s Contact Center: (063) 210 460, where the Customer lists and accurately states the desired products and services as well as the number/quantity of such products and services required by the Order and confirms the Order in the same way.

Contract – a bilateral contractual relationship between the Buyer and the Seller, in accordance with these Terms and Conditions, which the Buyer expressly accepts by purchasing goods and/or services at a distance. Terms and conditions are considered an integral part of the Agreement.

ELTA Internet store information

On the website, we strive to ensure the accuracy of the information, including descriptions of our products and services, as well as up-to-dateness when changing the prices of products, goods, and services. Unfortunately, omissions can sometimes occur. We will try to eliminate the difficulties as soon as possible.

If any difficulties would affect the status of the Order, we will certainly notify the Customer without delay.

Intellectual property law

In accordance with our rules on privacy and intellectual property, all content and material published on the website: www.ELTA.org.rs is fully and exclusively the property of the ELTA Association. Use of the content of this website/domain without the express consent of ELTA is not in accordance with the regulations governing the protection of intellectual property. The name, term, logo, ELTA mark, and the corresponding graphic representation/solution are also trademarks of the ELTA Association and are subject to the provisions of regulations governing and protecting intellectual property.

Each Website Visitor expressly agrees that they will use these web pages solely at their own risk. ELTA, or any of its employees or third-party service providers, does not warrant that the use of this website will be uninterrupted, intercepted, or error-free; nor does it guarantee for the consequences that may arise from the use of this website, or/and the accuracy, reliability or content of any information, service or product provided through this website.

This statement of liability applies to all direct (actual) or indirect damage (lost profits), any injuries caused by any deficiencies, error, exemption, interruption, deletion, malfunction, delay in operation or transmission, computer virus, interruption in communication, theft, destruction or unauthorized access, alteration or misuse of records on computer equipment or property of the Visitor, termination of the contract, misconduct, negligence, or any other action of the ELTA Association, or its employees and/or third-party service providers. The Visitor expressly confirms that the ELTA Association is not responsible for any possible offensive, inappropriate or illegal behavior of other users or third parties and that the risk of damage that may arise as a result of the above is fully borne by the Visitor.

In no event shall ELTA, or other natural or legal persons involved in the creation, production, or distribution of this website, or related content and/or software, be liable for any damages that may arise as a result of the use or inability to use of these websites. The visitor expressly confirms that the Terms of this chapter apply to the entire content of this website.

The Visitor is solely responsible for the purchase, use, and maintenance of their computer equipment, including but not limited to all software and hardware that they own and use, as well as other equipment needed to access and use the ELTA Internet sales website and all related costs. ELTA is not responsible for any damage to the Visitor’s equipment that may occur as a result of using this website.

To avoid any doubt about the disclaimer by the ELTA Association, the Visitor will not be denied the prescribed rights, as well as the rights arising from the contractual relationship with the ELTA Association.

Processing and protection of personal data

ELTA is committed to protecting and respecting your privacy.

One of the most common cases, when we collect personal data of our consumers, is when joining the ELTA Association. Any person over the age of 18 can become an ELTA member. You can read more information about joining the ELTA Association here. When registering on the ELTA website, we will ask you to leave us the personal data necessary to register your profile. We use your personal information to better understand your purchasing needs and preferences and to prepare offers and provide you with information about products and services you may be interested in. Newsletters with information about current offers are sent to you as part of the Program. This information will only be sent to you if you give us your consent, which you can find on the ELTA website.

ELTA makes every effort to protect all personal data used in the purchase of products and services (eg protection of personal data when sending promotional materials, when making an Order, as well as when paying by card).

Product information

You need to pay attention to the following details when buying products through the online store or by phone:

ELTA will try to ensure that the information on the website is up-to-date, especially the prices of the products and services offered.

ELTA is not responsible for any errors in product descriptions, images, and errors during page updates and price changes.

In the event of an error that significantly affects the Customer’s decision on the Order, the Customer reserves the right to cancel or amend the Order.

Availability of products and services

Product inventory data in the ELTA Association are subject to change and may differ from the information published on the website.

ELTA reserves the right to withdraw any product from sale at any time. In such cases, the ELTA Association returns the full amount of money to the Buyer of the undelivered but paid product, ie paid services, for those products that are no longer on offer. ELTA also reserves the right to change and timely suspend or discontinue the provision of the online store and application service.

Conformity of goods to the Contract and resolution of complaints

Your consumer rights regarding the conformity of the goods are protected by filing a complaint to the seller. To exercise these rights, it is necessary to enclose an invoice or other proof of purchase (copy of the receipt, slip – if the goods were paid by card, printed statement from the current account, etc.).

The Consumer may file a complaint to the Seller to exercise his consumer rights regarding the conformity of the goods in the contract, as well as due to incorrectly calculated prices and other defects.

The consumer can make a complaint:

• orally at the point of sale where the goods were purchased;
• by phone (063) 210-460;
• in writing by letter addressed to the ELTA Association, Nemanjina 28, Belgrade,
• electronically, ie on a permanent record carrier, via a contact form.

Complaints can be accepted only with the submission of an invoice for inspection or other proof of purchase (copy of the receipt, etc.).

Upon receipt of the complaint, ELTA will without delay examine reliably whether the complaint is justified and no later than 8 (eight) days from the date of receipt of the complaint, in writing or electronically respond to the complaint.

Any disputes between the Customer and the ELTA Association will be resolved amicably, otherwise, the jurisdiction of the court in Belgrade is agreed upon.

REGISTRATION, ORDERING, AND PURCHASING

Registration

For internet or phone shopping, you need to be at least 18 years old.

The buyer is responsible for the accuracy and completeness of the data entered during the purchase.

Order – general

ELTA Products and Services may be ordered online and by telephone, in accordance with these Terms and Conditions.

ELTA reserves the right to reject the Order in cases of force majeure or when the performance of a contractual obligation is significantly hindered. If the ELTA Association rejects the Order, the Customer will be notified within 4 working days after sending the confirmation of receipt of the Order.

Order online

Products and services are ordered electronically, through the online store of the ELTA Association. Products are considered ordered at the moment when the Customer completes the entire ordering process. Then the Customer will receive a confirmation of receipt of the Order by email.

After making and confirming the receipt of the Order, the Customer will receive a confirmation that the ELTA Association has received the Order to the e-mail address submitted.

Order by phone

Products and services are ordered by phone, through the Contact Center of the ELTA Association: (063) 210 460. The Customer lists the desired products and services to the person in the Contact Center as well as the number/quantity of such products and services required by the Order and orders them that way. (Important note: The Seller hereby informs the Customer that for this type of Product Purchase service, the possibility of payment by payment cards, payment in cash, or by invoice is provided).

The contract is considered concluded at the time of payment.

Order cancellation

General Terms of Order Cancellation

The Customer has the right to cancel the Order for delivery services at any time, by calling the telephone number of the Contact Center of the ELTA Association from 9 am to 4 pm every working day of the week.

The procedure for canceling an order when ordering online

During the successfully made Order via the Internet, the Customer received the so-called confirmation email (ie confirmation of a successful Order sent by email), which, among other things, contains a link through which the Customer can monitor the status of the Order.

ELTA processes the request for cancellation of the order when ordering online and notifies the Customer electronically of the outcome to the delivered email address of the Customer.

The Customer has been informed that it is possible to cancel the order when ordering online.

Phone order cancellation procedure

The Customer can cancel the telephone order by filling out the contact form on the WEB page, or by calling the Contact Center at (063) 210 460 and requesting the cancellation of the order by telephone. ELTA will confirm the cancellation of the order to the customer.

The Price

All prices displayed in the online store of the ELTA Association are expressed in local currency – dinars (RSD). ELTA is not a value-added taxpayer.

Products are charged at the prices valid on the day of ordering and published on the website. Prices, payment terms, and special offers are valid only at the time of payment and are subject to change without notice. ELTA will endeavor to ensure that the prices stated in the order are correct, however, errors or deviations may occur.

If the price of the product changes during the processing of the Order, or the price on the website for any other reason does not correspond to the actual price of the product or service, ELTA Association will allow the Customer to cancel the purchase or confirm a new changed price.

If paid with payment cards of foreign Issuing Banks, the dinar amount of the transaction will be converted into the settlement currency of the Bank (EUR) according to the exchange rate of the National Bank of Serbia. When debiting your payment card, the already converted amount will be converted into your local currency, according to the exchange rate applied by the payment card operators. The stated price, which is different from RSD and stated on the site, is of an informative nature and due to the stated conversions, it may deviate.

Conversion statement

All payments will be made in the local currency of the Republic of Serbia – dinar (RSD). The exchange rate of the National Bank of Serbia is used for an informative presentation of prices in other currencies. The amount for which your payment card will be charged will be expressed in your local currency through conversion into the same at the exchange rate used by card organizations / your issuing bank, which cannot be known to us at the time of the transaction. As a result of this conversion, there is a possibility of a slight difference between the original price listed on our website and the one you can see on your bank statement. Thank you for your understanding.

 

Security statement

When entering payment card data, confidential information is transmitted via the public network in a protected (encrypted) form. The security of data during the purchase is guaranteed by the payment card acceptor, Societe Generale Belgrade, so the complete payment process is performed on the bank’s website. At no time is payment card information available to our system.

Payment

Payment for goods and services ordered through the online store of the ELTA Association is made electronically. It is possible to use debit or credit cards for shopping in the online store of the ELTA Association.

Payment for goods and services ordered by phone is made by payment by invoice.

Refund of funds collected

In case of return of goods and return of funds to the customer who previously paid for one of the payment cards, in part or in full, and regardless of the reason for the return, ELTA is obliged to return only through VISA, EC / MC, and Maestro payment methods, which means that the bank will, at the request of the seller, refund the funds to the account of the payment card user.

RIGHT TO WITHDRAW

The right to withdraw from the contract

In addition to the rights defined in these Terms and Conditions related to the return of products, according to applicable regulations, the Customer, in the case of online and telephone purchases, has the right to cancel and return the purchased goods, within 14 days, for any reason and without explanation. ELTA reserves the right to determine the impaired value of the product when refunding money, in accordance with the Law on Consumer Protection.

The Customer exercises the right to withdraw from the Contract by a statement that he can give on a special form for withdrawal from a distance contract, which he receives with goods purchased by phone or online (withdrawal statement), as well as in any other unambiguous way. The statement of withdrawal from the Agreement has legal effect from the day it is sent to the ELTA Association.

If the Buyer withdraws using the electronic withdrawal form, ELTA is obliged to notify him of the receipt of the form without delay in writing or on another durable medium.

These Terms and Conditions of the Association of English Language Teachers – ELTA are valid from the date of publication on the website from 1 December 2020.
